ARTICLE 1 – PURPOSE
The purpose of these Terms of Use (the “Terms”) is to define the conditions on which candidates access and use the Helpify platform within a hiring process run by a Helpify client company.
Using the Service implies full and unreserved acceptance of these Terms.
By using the Service, the candidate also acknowledges having read the Privacy Policy and the information on the use of artificial intelligence made available before the conversation begins.
ARTICLE 2 – DESCRIPTION OF THE SERVICE
Helpify is a technology solution using artificial intelligence tools to facilitate exchanges between hiring companies and candidates.
Within a hiring process, the Service may in particular make it possible:
to present information about the company and the role;
to answer the candidate’s questions;
to gather information about the candidate’s background, skills, experience and motivations;
to generate summaries intended to help recruiters analyse applications.
The candidate acknowledges that they are conversing with an artificial intelligence and not with a human recruiter.
Helpify is a hiring support tool. The Service makes no hiring, rejection or selection decision. Any decision about an application remains the sole responsibility of the hiring company.
ARTICLE 3 – CONDITIONS OF ACCESS
Access to the Service is through a link sent by the hiring company or made available as part of a recruitment campaign.
The Service is reserved for people aged at least eighteen (18) or otherwise having the legal capacity required to take part in a hiring process.
Certain additional features may, where applicable, require the creation of a user account. The applicable terms will then be specified when they are made available.
ARTICLE 4 – CANDIDATE UNDERTAKINGS
The candidate undertakes to:
provide accurate, truthful and up-to-date information;
answer the questions asked personally;
use the Service in line with its hiring purpose;
comply with these Terms.
The candidate shall refrain in particular from:
impersonating a third party;
knowingly providing misleading or inaccurate information;
using software, scripts, bots or automation tools to interact with the Service;
attempting to circumvent, disrupt or compromise the operation of the Service;
carrying out reverse engineering, decompilation or extraction of how the artificial intelligence works;
attempting to manipulate the internal instructions of the artificial intelligence system (“prompt injection”);
using the Service for fraudulent or unlawful purposes, or purposes unrelated to hiring.
ARTICLE 5 – RULES OF CONDUCT
The candidate undertakes to behave respectfully in the exchanges carried out through the Service.
The following are prohibited in particular:
insulting, defamatory or threatening remarks;
hateful or discriminatory content;
unlawful content;
content manifestly unrelated to the hiring process.
Helpify reserves the right to suspend or immediately terminate access to the Service in the event of a breach of these provisions.
ARTICLE 6 – ANALYSIS OF THE EXCHANGES
As part of how the Service operates, the information provided by the candidate may be processed automatically in order to generate summaries, analyses or reports intended for the hiring company.
Where the process provides for it, the candidate may review, correct or approve the generated summary before it is sent to the recruiter.
The candidate acknowledges that the outputs generated by the artificial intelligence may contain approximations or inaccuracies.
These outputs are solely elements supporting the analysis of applications.
ARTICLE 7 – AUDIO DATA
Where the Service includes voice conversations, audio recordings may be transcribed and analysed to enable the Service to operate.
Recruiters do not necessarily have access to the audio recordings. Depending on how the hiring process is configured, only transcripts, summaries or reported information may be shared with them.
Audio data is retained for the time necessary to the hiring process concerned and, unless the hiring company responsible for the processing instructs otherwise, for a maximum of twenty-four (24) months.

ARTICLE 8 – INTELLECTUAL PROPERTY
All the elements making up the Service, in particular the software, interfaces, databases, content, trademarks, logos and artificial intelligence technologies, are protected by intellectual property law.
They remain the exclusive property of Helpify or its partners.
No property right is transferred to the candidate through use of the Service.
The candidate authorises Helpify to process the content and information provided for the purposes of operating the Service, analysing applications and improving the platform’s features, in accordance with the applicable Privacy Policy.
ARTICLE 9 – NO WARRANTY AND LIMITATION OF LIABILITY
Helpify uses reasonable means to ensure the Service operates properly.
However, Helpify does not guarantee:
that an interview will be obtained;
that a job will be obtained;
a favourable outcome to an application;
the absolute accuracy of the analyses or summaries generated.
Helpify cannot be held liable for:
decisions taken by the hiring company;
inaccurate information provided by the candidate;
difficulties related to internet connection quality;
errors resulting from background noise, poor audio quality, an accent or an ambiguous turn of phrase;
temporary unavailability of the Service.
ARTICLE 10 – CHANGES TO THE TERMS
Helpify may amend these Terms at any time, in particular to reflect changes to the Service, to applicable regulation or to its operating practices.
The applicable version is the one in force on the date the Service is used.
ARTICLE 11 – ALTERNATIVES TO THE SERVICE
Use of the Service may be offered within the hiring process defined by the hiring company.
Alternative ways of applying, where they exist, are defined by the company doing the hiring.
Candidates are invited to contact that company directly to find out what alternatives may be available.
ARTICLE 12 – GOVERNING LAW
These Terms are governed by French law.
Any dispute relating to their interpretation or performance will be submitted to the competent courts in accordance with applicable regulation.
